This website (the "Site") is an Internet-based on-line information and communication service. It is made available to you by Atrium Health, through our software vendor. BY ACCESSING OR USING THE SITE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT.  PLEASE READ THEM CAREFULLY.  IF YOU DO NOT WISH TO BE BOUND BY THIS AGREEMENT, YOU MAY NOT ACCESS OR USE THE SITE. TO THE EXTENT THAT YOU ARE ACCESSING MY ATRIUM HEALTH AND THE SERVICES DESCRIBED HEREIN AS A PARENT OR LEGAL GUARDIAN OF A MINOR CHILD, REFERENCES TO “YOU” OR “YOUR” THROUGHOUT THESE TERMS OF USE APPLY TO YOUR CHILD AS APPLICABLE.

WE MAY MODIFY THIS AGREEMENT AT ANY TIME, AND SUCH MODIFICATION SHALL BE EFFECTIVE UPON POSTING.

The informational content contained on the MyAtriumHealth home page and in the sections on Help and Resources is presented for the purpose of educating consumers on wellness and disease management topics. Atrium Health may send you information regarding common medical and health related topics or preventive care messages containing medical and health related information, links to other related web sites, specific questions related to your Atrium Health Medical Record and information or questions about health research. Additionally, Atrium Health may make information available to you about Atrium Health facilities and services, and may provide updates relevant for your visits to, or use of, Atrium Health facilities, resources, or services. These communications and resources are for general educational, research, or informational purposes only, and is not intended to be used for medical diagnosis or treatment. The information should not be considered complete or timely, nor should it be relied on to suggest a course of treatment for a particular individual. In many situations, you may need to talk to your healthcare Provider to interpret what you are seeing. If you have questions, please contact him or her.

1.b.      Health Records; Appointments and Billing;MyAtriumHealth Settings

The information contained in the Health Record, Visits, Billing and Settings sections of MyAtriumHealth is compiled from a variety of sources ("Content Providers") and is to be used by you to access your health records and for the management of medical bills and scheduling healthcare services. Neither we nor our Content Providers directly or indirectly practice medicine or dispense medical services as a part of these functions. You acknowledge that you are aware that the information collected may be accessed by your Atrium Health provider, its agents, or other designated persons as Atrium Health deems necessary and appropriate.

We will not provide you with your entire medical record on this Site. If you want a complete copy of your medical record, please contact our Health Information Management department.

By using this Site and giving us your email address, you consent to us sending information to you about your health or reminders, including for appointments or follow up, from the portal to your personal email address. You may wish to review the Guidelines for Email with Patients available on our Site, www.atriumhealth.org under the Privacy link, for more information about the risks and benefits of using a personal email address. Please note that we will never send you an email asking for your confidential password. Call us immediately if you receive such an email.

This Site is monitored on a periodic basis, but it is not monitored 24 hours a day.  Please do not rely on it to communicate with your provider, particularly if you have an urgent medical situation. IN AN EMERGENCY, CALL 911.

1.c.      Financial Responsibility

While some insurance plans cover telehealth, there may be co-insurance costs or additional charges in the event MyAtriumHealth services are not in-network with your insurer.  By your participation, you choose to receive the services even if an insurance plan may not cover or continue to cover specific services, including the services rendered during your medical treatment. You are responsible for non-covered services, any out-of-network costs and applicable copays and deductibles for covered services.

1.d.      Symptom Checker

Symptom Checker is a common ailments and symptoms assessment tool. It is intended to be informational only and to help you assess whether to seek medical evaluation and treatment. Symptom Checker does not provide medical advice, a diagnosis, or treatment, which only occurs by seeing a health care provider. You should not rely on Symptom Checker as a substitute for medical advice, a diagnosis, or treatment. If you believe you are experiencing an urgent health issue or health emergency, you should contact your doctor, go directly to the closest emergency department to your present location, or call 911.

You should not rely on Symptom Checker as professional medical advice, diagnosis or treatment. Symptom Checker's care guidance is intended to be informational only. If you have a medical question, please contact your doctor.

You should only use Symptom Checker for non-urgent, non-emergency medical conditions. If you have an ongoing medical condition, you should not use Symptom Checker, but should contact your doctor regarding the symptoms you are experiencing. If you are at risk of infection or on immune suppression, you should not use Symptom Checker and should contact your doctor about the symptoms you are experiencing. You should only use Symptom Checker for your individual ailments or as a proxy for another individual, but only if you are a proxy in MyAtriumHealth for that other individual.

If any of your symptoms last longer than 24 hours, you should contact your doctor regarding those symptoms. If Symptom Checker suggests taking an over-the-counter medication, you should read the label before taking the medication. The label provides important information including the medication’s ingredients, side effects, warnings, and possible drug interactions.

You may view the care guidance you receive based on your answers the next time you review Symptom Checker. Your health care provider will have access to the questions and your answers after you use Symptom Checker.

Symptom Checker is based on CDC guidelines. Symptom Checker may use information such as your age and gender from MyAtriumHealth to create the Symptom Checker responses and care guidance. It is intended only for use for those individuals who reside in the United States. Use of Symptom Checker constitutes acceptance of these Terms and is subject to the MyAtriumHealth Terms & Conditions found at the bottom of the main MyAtriumHealth home page.

1.e.      Video Visits

Video Visits are available for some medical services as determined by you and your provider. By participating in an electronic exchange by video, you consent to receive services by interactive audio-visual communications to carry out consultations, evaluations, screenings, diagnosis, treatment, monitoring, or other communications if appropriate for your condition as assessed by your treatment provider. You understand that there are potential risks to this technology, including interruptions, unauthorized access, technical difficulties and call termination and that you are responsible for the security of your electronic device and the privacy of your surroundings. You understand that your healthcare provider may discontinue the telehealth visit if it is felt that the videoconferencing connection is not adequate to your situation and that there are no guarantees or assurances concerning the result of the telehealth visit. You are responsible for fully describing your medical history, conditions and symptoms and for scheduling or seeking any follow-up care recommended by your provider.

Your video visit will be documented in your medical record and your personally identifiable information will be protected in accordance with HIPAA privacy requirements as set forth in our Notice of Privacy Practices available at https://atriumhealth.org/for-patients-visitors/privacy. Video visits will be conducted using HIPAA compliance technology but Atrium Health cannot ensure the privacy or security of other video applications used.

If the patient is a minor or lacks capacity by your participation you are affirming that you are either the parent or legal guardian of the patient and have authority to seek medical assistance on behalf of the patient. If you wish to have family members participate in your video visit your consent to their participation is implied by your allowing them to join the visit.

Video visits are not designed, intended or appropriate to address emergency or life threatening medical conditions and should not be used in those circumstances. IN AN EMERGENCY, CALL 911.

1.f.       Health Messaging

Health Messaging is to be used for non-urgent, non-life threatening communication. If you have an urgent or life threatening issue, call 911 or go to the nearest emergency room. Your decision to communicate with a provider is voluntary and does not affect your ability to contact your facility directly to speak with your healthcare provider and use the medical services available in the traditional environment (such as in the physical presence of a provider or in a hospital setting). Secure messages may be screened by administrative staff before being forwarded to a healthcare provider.  Health Messaging is intended to supplement and not replace your existing primary care physician relationship. 

Health Messaging is provided over a secure connection. Secure messaging is not email. No part of the actual secure message will be transmitted via email. Security measures are in place to protect the privacy of the information transmitted. You are responsible for maintaining the confidentiality of your account and password, and for restricting access to your device.  It is your responsibility to ensure that your personal information is not compromised due to the lack of secure equipment and/or surroundings. 

You are responsible for logging out of Health Messaging when your session is finished and for closing the browser being used to access these services. If you print any secure messages, you are responsible for protecting that information.

Health Messaging communications may become a part of your confidential health record.  You have the right to access your medical record and see this information, subject to applicable privacy and medical records policies  

1.g.     Track My Health

Track My Health is a service provided by Atrium Health as a part of the MyAtriumHealth program to eligible patients who have consented to participate. Track My Health should be used by you to monitor your health condition. The information that you provide may be periodically accessed and reviewed by your treatment providers to monitor your information remotely. Track My Health is not a substitute for medical advice or attention, and is not designed to be used in case of a medical emergency. Track My Health is not intended to replace assessments that are a part of standard clinical practice nor is it intended to be used as the sole basis for making decisions about your medical care. It is your responsibility to seek independent medical advice or attention in the event of any health issues or an emergency health situation arising.

Track My Health allows you to input data through a number of approved devices, including information provided through the activity tracker Google Fit. Blood Pressure and Blood Glucose data from Google Fit may be used to manage your care. Your personal data provided through the use of Track My Health, including data from Google Fit, will be protected in accordance with HIPAA privacy requirements as set forth in our Notice of Privacy Practices available at https://atriumhealth.org/for-patients-visitors/privacy.  

You are responsible for the truth and accuracy of information provided through activity tracking devices, and acknowledge that any failure to do so could result in treatment decisions that could be harmful or ineffective. Correct installation and operation of your personal devices is necessary in order to receive Track My Health services. You are wholly responsible for the care and security of any device that you use to participate with Track My Health including the security of your surrounding environment. Users of Track My Health are responsible for implementing and maintaining adequate procedures and checkpoints to satisfy their particular requirements for accuracy of data input and output and maintain a means for the reconstruction of any lost data. You understand that Atrium Health cannot control the security settings on your computer or device or to whom you give access to your account and we are not responsible for any data breaches caused thereby. There is no warranty, condition or guarantee that Track My Health will operate continuously or error free.

If medically relevant, some of the information that you have provided as a part of Track My Health may be entered into your medical record.

Section 2. No Warranty.
ALL OF THE SERVICES AND INFORMATION ACCESSED THROUGH THE SITE (THE "INFORMATION") ARE PROVIDED "AS IS" WITHOUT WARRANTY, EXPRESS OR IMPLIED. WE HEREBY EXCLUDE ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR USE OR PURPOSE WITH RESPECT TO THE INFORMATION. THERE ARE NO EXPRESS WARRANTIES MADE AS A PART OF THIS AGREEMENT. WE AND OUR CONTENT PROVIDERS MAKE NO WARRANTY AS TO THE RELIABILITY, ACCURACY, TIMELINESS, USEFULNESS, ADEQUACY, COMPLETENESS OR SUITABILITY OF THE INFORMATION. WE AND OUR CONTENT PROVIDERS CANNOT AND DO NOT WARRANT AGAINST HUMAN AND MACHINE ERRORS, OMISSIONS, DELAYS, INTERRUPTIONS OR LOSSES, INCLUDING LOSS OF DATA. WE AND OUR CONTENT PROVIDERS CANNOT AND DO NOT GUARANTEE OR WARRANT THAT FILES AVAILABLE FOR DOWNLOADING FROM THIS ONLINE SITE WILL BE FREE OF INFECTION BY VIRUSES, WORMS, TROJAN HORSES OR OTHER CODE THAT MANIFEST CONTAMINATING OR DESTRUCTIVE PROPERTIES. WE AND OUR CONTENT PROVIDERS DO NOT WARRANT OR GUARANTEE THAT THE FUNCTIONS OR INFORMATION CONTAINED IN THE SITE WILL BE UNINTERRUPTED OR ERROR FREE.

Users of the Site are responsible for (1) implementing and maintaining adequate procedures and checkpoints to satisfy their particular requirements for accuracy of data input and output and (2) maintaining a means external to the Site for the reconstruction of any lost data.  While we have put in safeguards to protect the security and confidentiality of your Information on our Site, we cannot control the security settings on your computer or to whom you give access to your account, and we are not responsible for any data breaches caused thereby. 

Access to this Site requires that you create a unique password.  In order to protect your personal information from unauthorized access it is important that all users create a strong password that is not easily guessed.  If the password you create is easy to guess you take responsibility for any unauthorized access to your account.  Users of this Site are responsible for keeping their password safe.  Users of this Site who share their password and/or lose their password take responsibility for any unauthorized access to their account.  The link below provides guidance to assist you in creating a strong, secure password for your account:  https://www.atriumhealth.org/myatriumhealth/MyAtriumHealth-FAQ

Section 3. Use of Content; Ownership
The entire contents of the Site constitute a collective work protected under the copyright laws of United States and other copyright laws. We hold the copyright in the collective work. The collective work includes works that are the property of the Content Providers which are also protected by copyright and other intellectual property laws. In addition to the foregoing, the information posted on the Site is drawn from your medical record, as well as tests and other diagnostic information that will become part of your medical record.  While you are permitted access to your medical record, your provider owns the actual record, in accordance with state and federal laws.  You may display and, subject to any expressly stated restrictions or limitations relating to specific material, download portions of the material from the different areas of the Site solely for your own non-commercial use, unless otherwise permitted. Any redistribution, retransmission or publication of any copyrighted material is strictly prohibited without the express written consent of the copyright owner. You agree not to change or delete any proprietary notices from materials downloaded or printed from the Site. Unauthorized use of the content may violate copyright, trademark, and other laws. None of the content may be reverse-engineered, disassembled, decompiled, reproduced, transcribed, stored in a retrieval system, translated into any language or computer language, re-transmitted in any form or by any means (electronic, mechanical, photo reproduction, recordation or otherwise), resold or redistributed without our prior written consent.  Any requests for amendment to your information must be addressed through the formal amendment process; please contact your provider for more information.

Upon acceptance of the terms and conditions contained in this Agreement, we authorize you to view or download a single copy of the material on this website solely for your personal, noncommercial use. Please note that we are not responsible for how you use or disclose your individual health information. Special rules may apply to the use of certain software and other items provided on the Site. Any such special rules are listed as "Legal Notices" on the Site.

Section 4. User and Member Representations.
You represent and warrant to us and our Content Providers that:

1. you are at least 18 years of age OR you are at least 13 years of age with the approval of your Physician and Parent or Guardian;
2. you possess the legal right and ability to enter into this Agreement on behalf of yourself and/or your minor child and to use the Site in accordance with this Agreement;  
3. you shall be financially responsible for your use of the Site (as well as for use of your account by others, including minors living with you); and
4. you shall comply with your responsibilities and obligations as stated in this Agreement.

Section 5. Limitation of Liability; Waiver; and Release.
YOU AGREE THAT NEITHER WE, NOR OUR COMMISSIONERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PROVIDERS, CONTENT PROVIDERS OR SUPPLIERS SHALL HAVE ANY LIABILITY TO YOU UNDER ANY THEORY OF LIABILITY OR INDEMNITY IN CONNECTION WITH YOUR USE OF THE SITE. YOU HEREBY RELEASE AND FOREVER WAIVE ANY AND ALL CLAIMS YOU MAY HAVE AGAINST US, OUR COMMISSIONERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PROVIDERS, CONTENT PROVIDERS, CUSTOMERS, OR SUPPLIERS FOR LOSSES OR DAMAGES YOU SUSTAIN IN CONNECTION WITH YOUR USE OF THE SITE.

Section 6. Indemnity.
YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS US, OUR COMMISSIONERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PROVIDERS, CONTENT PROVIDERS, CUSTOMERS AND SUPPLIERS FROM AND AGAINST ALL LOSSES, EXPENSES, DAMAGES AND COSTS, INCLUDING REASONABLE ATTORNEY'S FEES, RESULTING FROM ANY VIOLATION OF THIS AGREEMENT OR ANY ACTIVITY RELATED TO YOUR ACCOUNT (INCLUDING INFRINGEMENT OF THIRD PARTIES' WORLDWIDE INTELLECTUAL PROPERTY RIGHTS OR NEGLIGENT OR WRONGFUL CONDUCT) BY YOU OR ANY OTHER PERSON ACCESSING THE SITE USING YOUR SERVICE ACCOUNT.

Section 7. Third Party Beneficiary
The provisions of paragraphs (Waiver, Release and Limitation of Liability) and (Indemnification) are for the benefit of us and our commissioners, officers, directors, employees, providers, agents, licensors, suppliers, customers and Content Providers. Each of these individuals or entities shall have the right to assert and enforce those provisions directly against you on its own behalf.

Section 8.  Miscellaneous
We have the right to monitor your use of the Site.  If we determine that you are using the Site for improper purposes; are acting in an inappropriate, illegal, threatening, or harassing manner; are introducing viruses or other harmful codes into the Site; or are otherwise using the Site in a manner that violates this agreement or jeopardizes us, we have the right to terminate your use and access of the Site.  Any disputes regarding this Site are governed by the laws of North Carolina, and venue will be in the courts of Mecklenburg County, North Carolina.

To use MyAtriumHealth and all of the components thereof you must agree to be bound by all of the terms of this Agreement.  It is your responsibility to review these Terms and Conditions regularly as your use of the service following such changes indicates your acceptance of the revised Terms and Conditions. 

By electronically agreeing to the Terms and Conditions during the MyAtriumHealth enrollment process, you are indicating that you have read and understand the above and agree to be bound by all of the terms in this Agreement, and that you agree to participate in the MyAtriumHealth program.  

Proxy Access Disclaimer

I understand that I have been given permission to access the medical information of another person (patient) through MyAtriumHealth. I have read and agree to the MyAtriumHealth Terms and Conditions of Use which are posted at https://atriumhealth.org/myatriumhealth/terms-of-use-for-myatriumhealth. If I share my MyAtriumHealth username and password with another person, that person may be able to view the patient’s health information and such access will result in termination of my proxy access to the patient’s MyAtriumHealth. Furthermore, I understand that Atrium Health can terminate, suspend or revoke access the patient’s MyAtriumHealth account at any time at its own discretion.

I understand that MyAtriumHealth is intended as a secure online source of confidential medical and billing information. I understand that MyAtriumHealth contains selected, limited medical information and that it does not contain the complete medical record. I also understand that a patient (or a parent/legal guardian) may request a copy of his/her medical record from the Health Information Management Department.

I understand that adult patients with their own MyAtriumHealth account can revoke a proxy's access via the patient's own MyAtriumHealth account at any time. If I am the legal representative of an adult patient, I understand that if my relationship as legal representative of the patient changes, Atrium Health must be immediately informed by sending written notice to the Health Information Management Department.

If I am requesting access on behalf of a minor child, I understand that I will be expected to provide legal documents to support my right to the minor’s records upon request. I agree that I will notify the Health Information Management in writing immediately if my relationship with the minor child changes, i.e. if I am no longer the guardian or representative of the child or parental rights are terminated. I also understand that if I am the parent or legal guardian of a minor patient, my proxy access will be deactivated once the minor patient attains the age of eighteen (18) years. I also understand that information on the MyAtriumHealth website may be drastically limited related to certain types of treatment as under state law, minor children may choose to keep certain types of medical information confidential and refuse to grant access to their parent or legal guardian.

Note: Patient account information will be accessible by all individuals with proxy access. Such information includes billing details and contact information for the person who is financially responsible for the patient. If you are financially responsible for the patient's medical bills and are concerned about an additional proxy (i.e. a non-custodial parent) gaining access to this information please contact the MyAtriumHealth support team at 855-799-0044 or MyAtriumHealth@atriumhealth.org.

I acknowledge that I have read and understand the MyAtriumHealth sign-up information. I agree to its terms and choose to designate myself as the MyAtriumHealth Proxy of the patient listed above, thereby allowing access to the patient’s MyAtriumHealth medical record.
